The U.S. economy may be heading into a tailspin, but the prospect of a long and painful recession hasn’t stopped life brokerages agencies and independent marketing organizations from building out their businesses in 2008. Whatever the nation’s financial woes, sources tell National Underwriter, substantial investments in people, technology, geographic reach, marketing budgets—and, yes, fattened commission checks for producers—were critical to helping these middlemen keep pace in an increasingly competitive marketplace.
“The critical mass needed just to stay in the game is getting so high,” says S. Reed Ashwill, president of Borden Hamman Agency of Dallas, Tex. “We have to do so much more in production to stay at the same level that we had to change our business model.”
Adds John Bulbrook, CEO of Wellesley, Mass.-based Bulbrook/Drislane Brokerage: “There may be a recession, but we’re choosing not to participate in it. To succeed in this business, we’ve got to meet more people and work smarter. There’s no other way.”
Amid the credit crisis and economic contraction, IMOs and brokerage agencies reported mixed financial results. Jeff Cassat, a chartered financial consultant and vice president of marketing at Capitas Financial LLC, Minneapolis, Minn., notes that sales for the year were flat. Revenues from the firm’s national accounts (wire houses, banks and brokerages) were up, but revenues from the agency’s channel of independent advisors suffered a dip.
Likewise, Gary Baker, president of Baker Associates Insurance Agency, Scottsdale, Ariz., reports that, following a “fabulous” first quarter, sales steadily declined in the second and third quarters of 2008 owing to the deteriorating economy. But he expects to close out the 4th quarter with a 70% increase (though down 25% for the year in comparison to 2007).
To the extent that IMOs and brokerages enjoyed gains, sources say the souring economy—and clients’ concerns about their own shrinking nest eggs—actually contributed to the positive performance. Among those taking this contrarian view is Bulbrook/Drislane Brokerage, which enjoyed “excellent” sales of fixed annuities.
“Since the onset of the financial crisis, we’re seeing more new policy applications than ever before,” says Bulbrook. “Because of declining stock portfolios people are worried and they want something safe. Also, the rates on fixed annuities are now superior to those offered on CDs.”
The attraction of “safe” insurance products in tough times is not confined to clients. Cassat says many affiliated investment professionals have expanded their portfolios and expertise to encompass life insurance-funded estate planning and executive benefit solutions because of the revenue potential. Among his best national accounts, Cassat counts registered reps employed at UBS, Morgan Stanley and Wachovia.
Life brokerages agencies and IMOs had more than a faltering economy to contend with this past year. Market-watchers say that an increasingly competitive landscape has forced many of these firms to overhaul their business models with a view to achieving greater economies of scale, adapting to the needs of a more mobile and technology-savvy field force and strengthening relationships with producers.
To realize these objectives, Borden Hamman “dramatically” increased its capacity by hiring more “external wholesaler” reps who interface with producers to consult on clients’ product needs. The company also invested heavily in information technology to give producers faster access to product information on-the-go; and to develop a “virtual” workforce of wholesale reps.
“It used to be that you had to have people inside a brick-and-mortar building to make things happen,” says Ashwill. “Thanks to voice-over-IP and other Internet-based technologies, the way we do business has changed. Now, I can hire employees anywhere in the U.S and interface with them remotely. But these technologies have also raised expectations in that advisors and their customers now demand instant access to information.”
Capitas Financial, too, expanded its national footprint, albeit on a more decentralized basis. The limited liability company is owned by 29 partners who, while sharing products, technical expertise, sales materials and IT resources, independently run businesses in their respective cities. In 2008, the company boosted the marketing presence and field support to many of the metro areas where some 180 affiliated producers operate.
The firm, which had long specialized in estate planning and executive benefits, also expanded its portfolio to long-term care insurance, corporate- and bank-owned life insurance (COLI/BOLI) and life settlements products.
Yet another independent life brokerage that is betting its future on an expanded field force is Cavalier Associates of Westlake Village, Calif. One of 56 member firms in the Advantage Insurance Network, the company this past year boosted its staff by 30% and its producer base by 25%, bringing the total to 600 agents. That has allowed the firm to make up in sales volume what it has lost on a per-case basis due to the faltering economy.
“Personal net worths have fallen dramatically, and that’s translated into smaller life insurance policies for funding estate and business plans,” says Jason Cavalier, president of Cavalier Associates and a chief marketing officer at Advantage Insurance Network. “The largest slowdown has been among older clients in the affluent market.”
The firm’s shift toward greater volume and smaller case sizes has also heightened its focus on a long-underserved demographic: prospects occupying the middle income brackets. But Cavalier acknowledges that nabbing a larger share of this market will remain an uphill battle so long as insurance products remain a more complicated and time-consuming sale than that required for other financial products, such as bank CDs.
For Gary Baker, however, the key to boosting sales in the middle market—and attracting more producers to the firm—is to boost commission bonuses. To that end, Baker’s firm partnered this past year with Brokers Alliance, a Fountain Hills, Ariz.-based IMO that enjoys a high-volume business selling term and universal life, annuities and disability income insurance.
“By marrying with Brokers Alliance, I’ve been able to boost transactions, which in turn has allowed me to pay a higher percentage in sales commissions to agents,” says Baker. “And that’s gotten their attention.

The number of Muslims in Denmark has reached about 200 thousand, out of a population of nearly five and a half million people. The history of Muslims coming to Denmark goes back to the 1960s, when large groups of people emigrated from Pakistan, the Arab Maghreb and Turkey, and moved to the Scandinavian country. Others came to Denmark in the 1980s, when the path of immigration was opened for Arab countries. Observers attribute this to a number of causes, some of them demographic, as natives of Denmark are few in number, and some falling within the framework of allowing Palestinians to immigrate in order to reduce pressures on Israel. These observers stress that immigrating to Denmark in the 1980s was very easy for Palestinians. The 1990s were characterized by the arrival of large groups of immigrants from Afghanistan, and later from Iraq.


Once one begins to speak of the nature of the relationship between Muslims and the state in Denmark, one get a feeling that there is a huge gap separating the two sides, despite long years having passed since these people have been present on Danish soil. Most of the members of Muslim communities there live at the expense of the state, despite some of them having resided in Denmark for over thirty years. Nevertheless, these people have not integrated into the job market. Very few of them, mostly from the younger generation, seek to get an education and a job in order to seriously integrate into life there, without that meaning giving up customs and traditions, and above all the Muslim religion. While educated people and college graduates are considered few among Arabs and Muslims, a large segment of them choose liberal professions, and work as drivers or as maintenance workers

Some Muslims, or , find great freedom in their Scandinavian home, to express their opinion and practice their religious beliefs without the least bit of inconvenience. Nevertheless, this does not prevent them from talking about the feeling of and in Danish society.

Although the gathering of Muslims in Denmark went through phases, their relationship with the government has been similar throughout the years. Muslims in Copenhagen all agree that until the end of the 1990s, there were no significant problems in the relationship with the state, although Danish nationals did not have a favorable opinion of people that had black hair or a dark complexion.

Asking about the Danish Fatah Al-Islam prisoners in the country in which they spent nearly 17 years of their lives is not easy. Moroccan national M.S., whom Mahmoud Assaad had said he knew very well, and despite his promises of speaking in an interview in person and not on the phone, remained abroad in Holland for a week, although he had assured me that he would return two days after our first phone call. Many people assured us that he would refuse to speak to anyone, and that he was difficult to reach. Some Muslims deem it unlikely that he would be leading a group or engaging in teachings. They consider him to be one of those people who chose the wrong path to study religion, and who now teach it with even greater error. They belittle the importance of his movement, and dismiss it as nonsense. Four young men, one of them only 16 years old, had been accused of planning terrorist activities in 2005, and from among the evidence of their involvement presented before the court was their relationship to Abu Ahmad. Many consider that the most dangerous problem afflicting mosques in Denmark and in other European countries is that of people following some religious cleric or other, who has taught himself by himself, and has understood Islam in a different way, one characterized by extremism.

In Copenhagen, Bustanis first wife told the story of the first phase, that of fleeing Lebanon, when they left Tripoli and went to the Ain Al-Hilweh refugee camp. From there they traveled to Greece, where they stayed with a relative, and then to Libya, where they lived for two years, until someone managed to get them visas and they moved to Denmark. Bustanis divorcee in Denmark, his wife in Lebanon, certifies that he has not divorced her according to Islamic law, and that she is shocked at what Walid has come to. Indeed, although she witnessed the phase of his radicalization, which started in 1996 when he began to forbid her from watching television or putting pictures in the house, and to ask her to cover her face. Nevertheless, she believes that he was exploited because he had a constant drive for in Iraq and in Afghanistan, especially during the period in which he met Mustafa Ramadan. Although she was not allowed to appear before men, Ramadans name is the only one she remembers from among his friends.


Bustanis first wife avoids talking to the media, as she fears for her children. She still lives in Denmark against his will, as he had sent her to Lebanon in 2001 in order to register the children at a religious school. However, after she learned about his second marriage, she took her five children and moved back to Denmark. She says he used to come visit his children two or three times a week, and would spend two or three hours with them. This contradicts the claims made by Bustanis second wife, who certifies that he used to visit them daily.

Some pieces of information coincide while others contradict each other or complete stories we had heard in Lebanon. Some people are cooperative, while others wonder about the reason behind researching such a topic, since the media and journalists are prejudiced against them, and deal with them on the basis that they are criminals without considering the reasons that led to this. Others still have reservations about allowing filming or attending Friday prayer. Nevertheless, everyone agrees on classifying the presence of European countries among those that export mujahideen in a transitory framework, and on not considering it a . Yet there remains Abu Ahmad and Abu Saud, and before them Abu Muhammad the Lebanese: prominent names which cannot be ignored in that respect.

Mustafa Ramadan (Amir Al-Majameeh)


He has turned into a symbol in Iraqi circles, after he was killed in a US raid west of Baghdad ion September 17, 2004. In Lebanon, Mustafa Ramadan was nicknamed Abu Al-Shaheed, and while staying in Denmark Amir Al-Majameeh, and became known as Abu Muhammad the Lebanese after he was killed in Iraq along with his eldest son Abu Suheil, who had not yet reached sixteen years of age. He is a Beiruti of Kurdish origin who married a Lebanese woman from Majdel Anjar in the end of the 1980s and moved with her to Denmark.


Those who knew Ramadan in Denmark say that he was a young man in his thirties, and one of the earlier immigrants. He was religiously committed from the start, and sought to take interest in young and to advise them of the necessity of preserving their religion and traditions.


He is father to five children, the eldest of whom was killed alongside him in Iraq, while the others live with his widow who recently got married. Some information indicates that Abu Muhammad, who was recruited in Denmark, was close to a group of Kurdish fundamentalists, and that his relationship with Abu Musab Al-Zarqawi began through his activities with the Ansar Al-Sunna group, an organization headed by Mullah Krekar, a resident of Norway. His relatives refuse to speak after what they went through following his death. Yet his name has become recurrent in many circles, and especially in the lectures of Salafist Jihadist theorists, who are eaten up by envy because he went to Iraq before them, and consider that any phase of their present lives is only a step towards following in his path.

NO-FAULT PARADISE: DWI

In November of 2003, plaintiff provider commenced this action to recover assigned first-party no-fault benefits in the sum of $1,879, plus statutory interest and attorney's fees. The parties entered into a stipulation of settlement in November of 2006. In August of 2007, plaintiff moved, pursuant to CPLR 5003-a, for an order granting it leave to enter a judgment after settlement, and providing that the judgment include provisions for additional interest and costs. The court denied the unopposed motion, and this appeal by plaintiff ensued.
CPLR 5003-a, enacted to encourage the prompt payment of damages in settled actions, authorizes a settling plaintiff to enter judgment against a settling defendant who fails to pay all sums as required by the statute (see Cunha v Shapiro, 42 AD3d 95 [2007]). Insofar as is relevant to the instant case, CPLR 5003-a (a) provides that the settling defendant "shall pay all sums due to any settling plaintiff within twenty-one days of tender, by the settling plaintiff to the settling defendant, of a duly executed release and a stipulation discontinuing action executed on behalf of the settling plaintiff" (emphasis added). The term "tender," as used in the statute, is defined as meaning "either to personally deliver or to mail, by registered or certified mail, return receipt requested" (CPLR 5003-a [g]). Should the settling defendant fail to make prompt payment of all sums due, the unpaid plaintiff "may enter judgment, without further notice, against such settling defendant who has not paid" (CPLR 5003-a [e]). In order to avail itself of the enforcement mechanism of CPLR 5003-a, an unpaid settling plaintiff must adhere to the requirements of the statute by tendering a general release and a stipulation of discontinuance and by waiting 21 days following such tender (see Cunha v Shapiro, 42 AD3d 95 [2007]; see also Dobler Chevrolet v Board of Assessors, 2001 NY Slip Op 50013[U] [Sup Ct, Nassau County 2002]). In the instant case, plaintiff's submissions in support of its motion were insufficient to prove its tender to defendant of the release and stipulation of discontinuance. Accordingly, the order denying plaintiff's motion is affirmed, albeit on different grounds. We pass on no other issue.

Eleven people, including three U.S. citizens, have been indicted by the U.S. Department of Justice on charges relating to identity theft and hacking. The suspects were allegedly involved in the theft of more than 40 million debit and credit card accounts in the last three years, including the high-profile case in which the retail giant TJX claimed that over 46.5 million credit cards had been stolen.
U.S. Attorney General Michael Mukasey commented that the group "used sophisticated computer hacking techniques, breaching security systems and installing programs that gathered enormous qunatities of personal financial data, which they then allegedly sold to others or used themselves." They identified vulnerable commercial networks and collected credit card numbers, PIN numbers and other account data using network sniffers. Some of the information was then sold on via servers in Eastern Europe and the United States.
Albert Gonzalez, one of the defendants, has been charged with computer fraud, wire fraud, access device fraud, aggravated identity theft and conspiracy. Two other Miami men, Christopher Scott and Damon Patrick Toey were also charged. The remaining members of the group (one of whom is only known by an online pseudonym), from countries which include Estonia, Ukraine, the People's Republic of China and Belarus, have been indicted for running and international distribution ring for stolen debit and credit card accounts. If Gonzalez is convicted, he could be sentenced to life in jail.
Mukasey characterized the case as "the single largest and most complex identity theft case ever charged in this country." He also commented that the outcome "shows that, with the cooperation of our law enforcement partners around the world, we can identify, charge and apprehend even the most sophisticated international computer hackers".

Im sure there are those of you out there who can relate to what Im about to write, which is one reason Im writing it.  Call it misery loves company, call it needing to get it off of my chest, whatever you want to call it I gotta say it.
I need to vent, and I need to share what I dream of, in hopes that one day itll come true.  It isnt some glamorous dream so if youre waiting on that,youre going to be disappointed.  Nope, it is quite simple actually.  Ready, here it is, I dream of a day when all my debts unsecured really such as medical bills and that darn credit card and other charge accounts I have are paid in full, and all I have to worry about are utitlties, food and other necessities.  I dream of this day because it would mean that we could LIVE on my husbands income and that my income would be totally gravy.  My income would allow me to do the little extras for my family that I desire.
I dream of this day because these days, Im working my booty off to earn money to pay all that stuff and it is making me burned out and frustrated.  It is taking away precious hours I could spend with my kids, and it is taking away the time I used to spend enjoying myself, as well as the time I spent pursuing my passion.  Now that my friends just isnt right.

Collecting Customers Emails
On average, insurance agencies have about 10% of their customers email addresses*. This low number can be attributed to a number of items. Some customers have been around longer than 10 years or so where collecting emails wasnt anything to think about. Many of the older agency management systems have never had a place to store email addresses or the agency never took the time to collect the email addresses.
Collecting email addresses can be very simple, but it may take some time.
When a customer is on the phone, submits something online or walks into your agency ask them for their email address. It will take a few extra minutes but over a couple months that 10% can easily jump to 20% or 30%.
Run a postcard promotion or contest (Requiring customers to give you their email address of course)
Privacy matters
When asking customers for email addresses explain to them how you plan on using their emails. (Email best practices)
Dont spam!
Newsletters can be a very simple way to promote your insurance agency and to build your web presence. However, if a customer gives you their email address dont assume that they are also interested in receiving your monthly newsletter. If you add them without asking first, they may opt-out, black list you or report your newsletter as spam. If they opt-out you should definitely respect their wishes and not send them anymore unsolicited emails. If they black list your email address then you will be unable to send them any more emails. (Even legitimate emails) If they report your newsletter as spam (All major web based email providers have this feature) your email address may be flagged as a spammer (This is something that is very hard, if not impossible to correct).

Best practices – How to use email addresses
Now that you have your customers email addresses what should you do? There are many legitimate reasons to email customers. When you first receive an email address from a customer send them an email talking about ways your insurance agency uses emails and your website to communicate with their customers. (This is a good place to promote your monthly newsletter and let them opt-in)
Legitimate Reasons to contact your customers:
Catastrophe or claims updates - A good example of this is during hurricane season in the south or ice storms in the north. Email your customers before and right after the natural disaster happens to remind them that there is valuable claims information for them on your website and to get it now before the power goes out.
Financial Times - As we know, even the largest of companies can fall or be bought out by another company. In times like these, it is a good idea to inform your customers that one of the reasons you are an independent agency is that you represent multiple carriers and that their insurance policy is safe.
Significant Changes - New service offered, new company or an office move.
Confirmation emails - Confirm policy changes, annual reviews or quote requests.
Follow ups - After a service was provided follow up and make sure your service level was satisfactory.
